PRESIDENT WILLIAM RUTO'S REWARD TO HIS LOYALS SNATCHED.
Judges Kanyi Kimondo,Hedwig Ong'udi and Aleem Visram said the public participation in creation of CAS posts was only conducted for 23 occupants and the creation of additional 27 occupants did not meet the constitutional requirement of public participation.
"The newly created office and fresh complement of 50 had to comply with the constitution and the criteria set earlier in Okiya's case in order to be lawfully established.They did not comply and therefore the entire complement of 50 CAS is unconstitutional," the court ruled out.
The court shed light to this dilemma that the additional 27 CAS positions did not adhere to the constitutional requirement of public participation and squashed the appointment.The 50 appointed CAS were sworn in by president William Ruto on 23rd March this year after National Assembly declined to vet them saying it had no constitutional authority.The high court then issued orders barring the 50 from assuming office.
Some of the appointed CAS had resumed their offices and began giving directives despite the court decision.Most of these presidential nominees were his strong allies to his presidential bid.This Solomonic declaration by the court has left the nominees lost in their thoughts after seeing their presidential award snatched.
On the other hand,this is a sigh of relief for the not only the opposition but also the public.The country will save 187 million shillings which could have entered the pockets of these loyals.These amount can be used to solve the neck gripping challenges facing Kenyans due to rapid increase of the standards of living.
Many Kenyans are finding it hard to meet their basic needs.The hand to mouth nature of earning canever meet the costs of commonly used commodities.Instead of the government extending a hand of appreciation to the loyals,should first think of the needs the common mwananchi is facing.
The cry of the helpless hustler is beyond explanation.The hustlers seem to have been neglected despite promised a great share in the Kenya Kwanza government.To them they have been used as a leader to leadership.
The government seem to have forgotten it's manifesto.Further more,the government should respect the constitution of Kenya and it's guidelines.Neglect of constitution is a lee way to bad governance.Kenya is bigger than any individual and therefore should be accorded the respect it deserves.
